
Terms, Conditions & Participation Disclaimer
United Community Foundation as part of its sport and recreation programmes, offers a variety of physical activities. We strive to make our activities as safe as possible. However, it is important to recognize that sports inherently carry the risk of accidents and injuries.
Our safety measures include:
- Ensuring coaches are qualified, and experienced.
- Conducting ongoing risk assessments of venues and activities.
- Regularly checking equipment for safety before each activity.
- Tailoring activities to be age and skill appropriate.
- Adhering to venue-specific policies such as fire, evacuation, and child protection.
- Providing constant supervision for children.
- Maintaining approachability in our coaches to address any concerns.
- Periodically revising our participants’ protection policies.
AGREEMENT TO WAIVER REQUIRED FOR PARTICIPATION
Acknowledgment and Assumption of Risk
I acknowledge the inherent dangers and risks associated with participating in these activities. I am aware that sports can lead to potential injuries and that provided protective gear may not fully prevent serious harm. I understand there may be risks not immediately apparent.
Despite this, I choose to participate/permit my child to participate, accepting and assuming all risks of property damage, injury, or death.
I understand that United Community Foundation does not offer participant insurance, and any desire for coverage should be arranged personally. The organization disclaims all responsibility for damages, injuries or death from the activity.
Waiver of Liability and Indemnification
In allowing participation in these activities, I release and hold harmless United Community Foundation and associated entities from all liabilities, claims, and demands arising from any injury, death, or harm during or related to the activity. This includes claims of negligence but excludes gross negligence or deliberate misconduct. I agree to defend and indemnify the Released Parties against all claims, including their negligence.
This agreement extends to my estate in the event of my/child’s death or disability, and my representatives will be bound to its terms.
Compliance and Behaviour
I agree to adhere to all instructions and regulations provided by United Community Foundation and its staff. Offensive or dangerous behavior will result in immediate dismissal from the activity.
Independent Contractors
I acknowledge that United Community Foundation is not responsible for the actions of any independent contractors involved in the activity.
Use of Image and Likeness
I understand that photographs or videos may be taken during the activity. Unless specifically denied permission, I grant United Community Foundation the right to use such images for any lawful purpose.
Severability and Governing Law
Should any part of this agreement be found invalid, the remainder remains effective. This agreement is governed by New Zealand law.
Full Understanding and Agreement
I have fully read and understood this agreement and sign it voluntarily. I acknowledge that it affects my legal rights. In the case of a minor participant, a parent or guardian must agree to these terms, accepting responsibility for the minor’s involvement.
Insurance
Please note that the United Community Foundation does not provide personal accident insurance cover. Costs related to injuries, including medical expenses, are the responsibility of the participant/parent/carer. While ACC may cover some medical expenses, and private health insurance may cover additional costs, all other expenses must be borne by the participant or their guardian. Participants and guardians should consider their insurance needs when deciding to engage in these activities.
Participants’ Consent
By participating in United Community Foundation’s sport and recreational activities, I agree that I have read all of the information contained in this form in relation to the activity and I am aware that:
- The United Community Foundation does not accept liability for accidents, injuries, disabilities or death of participants during its sports and recreation programs.
- The United Community Foundation does not have personal accident insurance cover for participants.
I give consent for myself/my child, to participate in the physical activities mentioned on the registration form. In the event of an accident or illness, I accept liability for all reasonable costs incurred by the United Community Foundation in obtaining any type of medical assistance or treatment (including any transportation costs) and undertake to reimburse the United Community Foundation the full amount of those costs.
